2012年中国足球超级联赛俱乐部运动员工作合同(中英文)2012’s ATHLETE EMPLOYE CONTRACT OF CHINESE SUPER LEAGUE
甲方：足球俱乐部 Party A: soccer club
乙方： 运动员 athlete
（国籍nationality 出生birth date of day month year 年 月 日）
甲、乙双方本着自愿、平等的原则，经过协商一致，签订本合同，以使共同遵守。Parties hereto，abiding by principles of equality, voluntarine and reaching unanimity through consultation, conclude and inter into this contract for observance.第一条合同期限 Clause I TERM LINMIT OF CONTRACT
合同期限为壹个赛季，从2012 年1 月1 日至2012 年12 月31 日止。Term limit of contract is one season which from the date of 1 January, 2012 till 31 December, 2012.（注：合同期限最短为1个赛季，最长为5个赛季）
Notice: the minimum term limit is one season and maximum term limit is five seasons.第二条工作安排 CLAUSE II CONTENT OF WORK1、甲方安排乙方在俱乐部一队从事训练、比赛和其他活动。
1.Party A make and enable Party B engage in training, game and other activity.2、甲方有权根据俱乐部的需要及乙方能力、表现和状态，在俱乐部一队及预备队之间调整工作岗位。
Party A have authority and right to, baseing on neceary of club and Party B’s ability, achievement and other condion, adjust his work post between first team and reserve team.第三条生活、工作条件和健康保护
CLAUSE III CONDITION OF LIVING, WORKING AND PROTECTION FOR HEALTH1、甲方为乙方提供清洁、卫生、舒适、便利的住宿安排和营养丰富的饮食安排，其中电话及其他通讯设施的使用费由乙方自理。
Party A shall provide Party B with a clean, sanitary and convenient quarter, and nutritious diet.The fees of telephone and other communication is expense of Party B.2、如乙方为外籍运动员，甲方应在上述安排基础上予以适当照顾。（如乙方提出更高的要求，经甲方同意，可在“补充协议”中另作安排，并明确承担费用的责任。）
Where Party B with foreign nationality, to whom Party A should give appropriate preferential treatment besides preparations hereabove.In case Party B require more superior accommodation which ,by agree of Party A,could be arranged otherwise in Supplement Agreement,in which clearly stipulate responsibility of taking related fees.3、甲方为乙方提供符合中国足球协会执教资格规定的教练员。Party A shall provide Party B with coach with competency of coach conforming to the requirement of China Football Aociation.4、甲方为乙方提供符合中国足球协会规定标准的草坪训练场和其他训练设施。
Party A shall provide Party B with lawn training field conforming to the standard of China Football Aociation and other apparatus for training.5、甲方为乙方提供甲方安排的训练、比赛和其他活动的交通、食宿和相关费用。
Costs and expenses of traffic and accommodation related to Party B’s training, game and other activities being arranged by Party A shall be borne by Party A.6、甲方为乙方提供乙方因公伤病的治疗安排及治疗费用和由此产生的相关费用。
Party A shall arrange Party B’s medical treatment for the illne and injury arising from work and bear fees and other related fees.7、甲方为乙方提供乙方非因公伤病的治疗安排及治疗费用（至解约或合同期满），但乙方因违法、违纪、违背社会公德或其他过错行为至使伤病的除外。Party A ,prior concellation or exepiration of this contract,shall arrange Party B’s medical treatment for the illne and injury arising from non-work and bear fees thereaof and other related fees except the illne and injury result in Party B’s actions of breaking law and regulation, breach of social morality or other fault.8、甲方为乙方本合同期内，办理养老保险、失业保险、大病保险及人身意外保险、住房公积金，或提供相应的金额由乙方自己办理。
Party A, within the term of this contract, effect the insurance of endowment, unemployment, catastrophic illne, personal accident and housing fund, or provide fund for Party B to effect same by himself.第四条教育培训 CLAUSE IV EDUCATION / TRAINDING1、甲方如需培养乙方成为教练员或管理人员时，为乙方提供相应的培训条件和费用。
In case Party A need to cultivate Party B as coach or administrator, Party A should offer him corresponding train condition and fees.2、甲方为乙方提供学习文化知识或其他业务知识和技能的条件和便利。Party A shall provide Party B with the condion and convenience to learn culture knowledge or other profeional competence and skill.第五条工作时间 CLAUSE V WORK HOURS1、甲方安排的工作期包括竞赛准备期和完整赛季。
The work term arranged by Party A include preparation period and whole season.2、甲方依照训练、比赛节奏、在上述工作时间，为乙方安排不少于天的休息日。Party A shall arrange Party B for off-day not le days in according to timing of training and game.3、甲方安排的工作，包括训练、比赛、学习、会议、其他活动等，平均每日工作时间不超过8小时。
Party B’s work hours per day shall not exceed eight hours for works arranged by Party A include trainding, game, study, meeting and other activity.第六条肖像权使用 CLAUSE VI ATHLETE’S PORTRAITURE RIGHT1、乙方享有本人肖像权，未经乙方同意，甲方不得以赢利为目的使用乙方肖像。
Party B enjoy himself portrait right to which Party A, without consent of Party B, shall not use Party B’s portrait for profit purpose.2、乙方同意甲方和中超委员会在社会公益事业活动、甲方或中超联赛宣传推广活动中，无偿使用乙方肖像，并予以积极合作。
Party B agree Party A use his portrait without compensation in social commonweal activity,propagand of China super league by Party A and committee of super league, and take cooperation actively.3、乙方同意在赞助商提供的广告宣传中，无偿使用乙方的肖像。
Party B agree Party A use its portrait without compensation in advertising propagand by sponsor.4、乙方同意中超委员会在为中超联赛赞助商提供的广告宣传中，无偿使用包括乙方在内的不少于5名中超联赛运动员的集体肖像。Party B agree Party A use collective portrait of more than five super league players among which include Party B free compensation for the purpose of advertising propagand to sponsor.5、乙方同意甲方有偿使用乙方肖像进行其他商业广告开发，乙方有权从中获％的收入分成。
Party B agree Party A use his portraint with payment for commercial advertisment and is entitle to get income division of % in sums of advertisement payment.6、乙方使用本人肖像为他人进行广告宣传，必须经过甲方批准，并向甲方上缴％的收入分成。
Party B use himself portrait make crommcial advertisement for others should subject to Party A’ s sanction and turn in % in sums of advertisement payment to Party A.7、乙方同意甲方和中超委员会有偿使用乙方肖像进行一系列商品开发，并应另行签订协议，获得合理收入。
Party B agree Party A and Super league committee use his portrait with payment for development of a series of commodity for which another agreement signed and from which get reasonable income.8、乙方获得的上述收入，由甲方代缴个人收入所得税。
Party B’s individual income tax arise out hereabove income shall be under withholding and collection taken by Party A.第七条工资和奖金 CLAUSE VII WAGE AND BONUS1、甲、乙双方执行中超委员会制定的《中超俱乐部一线球队工资奖励管理规定》，Parties hereto shall execute the Management Rule of Wage and Reward For Team In First Iine of Super League constituted by super league committee.2、甲方每月向乙方支付工资元（人民币/美元），其中达到国家规定缴纳个人所得税标准的部分，由甲方代扣代缴个人收入所得税。
Party A meke payment of Party B’s wage of(RMB / USD), the part among which reach the standard of individual income tax should, by state rull, be withhled of tax by Party A.3、如乙方参赛场次、时间或比率未能达到甲方要求时，甲方有权适度核减上述工资，并将核减办法写入补充协议。
In case the games, time or grade rate of Party B fail to reqirement of Party A, Party A is entitle to reduce Party B’s wage appropriately for which the means shall written in supplement agreement.4、甲方按照比赛性质、比赛结果和乙方上场时间、比赛表现的不同，向乙方支付比赛奖金。
Party A shall pay bonus to Party B in consideration of quality and achievement of game, playing time and behaviour.5、在中超联赛中，胜场奖金（个人打满全场）最低为元，（人民币/美元），平场奖金（个人打满全场）最低为 元（人民币/美元），负场无奖金，俱乐部按照每人报名与否及上场参赛时间的多少等因素发放，具体办法写入“补充协议”； In super league ,if Party B, playing full-court in winning game, shall take bonus of at least(RMB / USD);if draw game, Party B, playing full-court, shall take bonus of at least(RMB / USD);if lo game, no any bonus.Club shall pay bonus by consideratins of whether signing up or playing time for player to which the means shall written in supplement agreement.6、在其他比赛中，奖金依照比赛成绩、商业收入等具体情况另行确定； In other game the bonus shall be else decided by specific situation such as achievement and commercial income etc.7、除上述工资奖金外，甲方不再以任何名义向乙方支付其他的款项。Except wage and bonus hereabove, Party A shall not pay any other payment to Party B for any cause or reason.8、乙方因公（包括执行国家任务）伤病不能参加训练比赛，甲方应全额支付乙方工资并予以适当补偿（执行国家队任务者，其补贴相当于此间比赛的全队平均奖金）。
Where Party B fail to take part in training and game for injury or illne on busine include performing state’s aignment, Party A shall pay him wage in sum and appropriate compensation, which ,as allowance for performing state’s aignment, shall be equal to whole team’s average bonus.9、乙方因工伤不能参加训练比赛，而未接触本合同，甲方应向乙方支付不少于全额50％的工资，但乙方因违法、违纪、违背社会公德或其他过错行为致使伤病的除外。
Where Party B fail to take part in training and game for his injury or illne on busine which is not related to this contract, Party A shall pay him wage as not le than 50% sum wage, except of such arising out of breaking law, violating discipline and social morality or other fault act.10、本合同终止或合同解除，甲方不再向乙方支付工资。
Upon termination or expiration of this contract Party A no longer pay wage to Party B.11、乙方被调整至预备队期间，不再享受上述上述标准，只享受预备队的工资奖金待遇。Party B, during being adjusted to reserve team, shall no longer enjoy wage standard hereabove, only enjoy treatment of wage and banus of reserve team.12、甲方发放工资的日期为每月日，实行先工作后付薪制度。Pay day is the day of each month, payment follow working.13、比赛奖金发放的时期为每场比赛或每一奖励周期结束后天之内。Game banus is paid to Party B winthin days after each game or a period of encouragement.第八条福利待遇 CLAUSE VIII WELFARE1、甲方每赛季为乙方提供 次往返探亲交通费，实报实销或按次估发。Party A shall provide Party B with the round trip fees of home-traffic for times each season by reimbursement on actual expenses.2、甲方规定的其他福利待遇。Other welfares stipulated by Party A.3、中华人民共和国法定的其他福利待遇。
Other statutary welfares stipulated by government of People’s Republic of China.第九条义务和纪律 CLAUSE IX LIABILITY & DISIPLINE1、乙方必须履行下列义务： Party B should perform liability and duty herebelow:
（1）遵守中华人民共和国各项法律、法规；
Abide by various laws and rules of People’s Republic of China.（2）遵守国际足联、中国足球协会、中超委员会、中超联赛的章程、规程及个各项规定；
Abide by various constitution, regulation and prescription of FIFA, CFA, CSLC and super league.（3）遵守甲方的各项规章制度，服从甲方管理； Abide by various bylaw and obey management of Party A.（4）遵守职业道德，发扬体育精神，维护公平竞赛原则，维护甲方的形象和声誉；
Comply with profeional, carry forward sport spirit, stick up for principle of fair contest, maintain Party A’s good fame and honour.（5）保持身体健康和良好的竞技状态，最大限度地发挥体能和技能水平； Keep a strong healthy body and well athletics condition, farthest exert body ability and skill level.（6）参加甲方安排的所有训练、比赛和相关活动，努力完成规定的调练、比赛任务；
Take part in any and all training, game and related activity prepared by Party A, endeavor to perform aignment of practice and match.（7）参加甲方安排的所有社会公益、球迷服务、媒体宣传、赞助服务等活动；
Take part in any and all acts on social commonweal, serve to funs, propaganda and sponsor service, etc.（8）接受甲方安排的所有医疗检查、身体检测、防疫注射、预防措施、伤病治疗，及时向甲方报告自身的伤病情况及康复情况；
Take all medical check up,body examination, epidemic injection, prevention measure, treatment of injury / illne arranged by Party A and report Party A on his status of injury / illne and getting well.（9）使用甲方发放和制定的训练、比赛服装及各类装备；
Use dre being special for training and game as well as various furnishment provided and made by Party A.（10）外出集训、比赛等服从甲方的食宿、交通安排；
Subject or submiive to Party A’s preparation of board / lodging during out training and game.（11）参加非甲方安排的媒体采访、商业宣传和其他活动，必须经过甲方批准；
Take part in news interview, commercial propagander and other act prior to Party A’s sanction.（12）参加甲方按照中超委员会要求安排的活动；
Attend act prepared by Party A in accordence to the requirement of Super League Committee.（13）入选各级国家队时，参加国家队安排的所有训练、比赛和活动； If and whenever being elected into national team of all levels, Party B shall take part in all trainding, game and act planned by that team.（14）甲方认为必要的其他事项。Other item as deemed neceary by Party A.2、乙方必须遵守下列纪律
Party B should abide by discipline herebelow.（1）不得向外部组织、媒体和个人透露甲方的内部情况、信息、训练和比赛安排；
None of Party A’s inside information such as trainding and game shall be disclosed to outside institute, media and individual.（2）不得使用国际足联禁止的药物； Don’t use any drug forbided by FIFA.（3）不得与第三方签订有碍本合同执行的协议；
Don’t sign and conclude any agreement which be a hindrance to execution of this contract.（4）不得在未经甲方批准的情况下，参与其他的广告宣传或企业推广活动； Don’t attend other acts such as advertisement or corporation propaganda without prior consent of Party A.（5）不得在未经甲方批准的情况下，代表其他俱乐部或球队参加比赛； Don’t be in the field on behalf of other club or team without prior sanction of Party A.（6）尊重队友、尊重对方、尊重裁判、尊重观众、尊重工作人员、遵守比赛纪律无条件服从裁判员的一切判罚；
Respect for teammate, rival, umpire, audience and staff, abide by match rule and obey any judgement and punishment made by umpire.（7）不得参与假球、赌球、消极比赛或任何违背职业道德，有损甲方声誉及中超联赛的声誉的活动；
Don’t take part in any act relating to fake playing, bet-playing, negative playing or breach of profeional moral, and such as the same of damaging the reputation of Party A and Super League.（8）不得刻意发表攻击甲方、其他俱乐部、中国足球协会及其会员协会、中超委员会、运动员、教练员、裁判员、工作人员的公开言论。
Don’t release opinion on attacking Party A, other club, CFA and its aociation member, Super League Committee, player, coach, umpire and staff.3、违纪处罚 PUNISHMENT FOR VIOLATION OF DISCIPLINE
（1）乙方违反上述纪律，甲方将根据性质和情节依照相应规定予以处分，并可同时在乙方月工资总额50％范围内予以罚款；
Where Party B violate discipline hereabove Party A shall give him a punishment in accordance to the character and circumstance and impose penalty to the extent which within 50% of monthly wage amount.（2）乙方在比赛中被出示黄牌、红牌，受到停赛处罚，被处以罚款，罚款由乙方自己承担，同时甲方可在乙方月工资总额50％范围内或该场比赛奖金50％范围内追加罚款；
Where Party B, while playing in match, is brought forth yellow or red card , imposed punishment of ceasing game and penalty, shall aume such penalty by himself.Party A is entitle to surcharge him penalty which within 50% of monthly wage amount or 50% of that match’s bonus.（3）乙方严重违纪，对甲方利益或声誉造成重大损害，触及解约条款时，将被解除本合同。
Where Party B disobey discipline seriously which make material damage to Party A’s interests or reputation, this contract shall be termination in accordence to related clause herein.第十条工作合同的解除与不得解除
CLAUSE X TERMINATION & NON-TEMINATION OF CONTRACT1、经甲、乙双方协商一致，可以解除本合同。
This contract, by reaching unanimity through consultation by parties hereto, could be terminated.2、乙方有下列情形之一的，甲方可以解除本合同:
Party A is entitle to cancel this contract where there be circumstance or matter below with Party B:
（1）未能取得参赛资格或丧失参赛资格；
Fail to get or lose qualification of taking part in game.（2）隐瞒重大伤病，不能参加或严重影响训练和比赛； Connot joining or impact seriously on training and match for cause of hidene of grave illne / injury.（3）严重违反甲方规章制度或比赛纪律；
Disobey serously bylaw of Party A or match discipline.（4）严重违背职业道德或体育精神，对甲方利益或声誉造成重大损害； A serious violation of profeional moral or sport spirit which make material damage to Party A’s interests or fame.（5）被依法追究刑事责任或劳动教养；
Be proscuted for his criminal liability or indoctrination through labour by law.（6）非因工伤病，医疗期满后不能再从事该职业（应在30天前书面通知方）。Unable to engage in the profeion stipulated herein any longer on the date which expiration of medical treatment of non-busine illne / injury.For which 30 day advance written notice should be provided to Party B.3、有下列情形之一的，乙方可以通知甲方解除本合同；
Party B chould cancel this contract by written notice to Party A for the circumstance and matter below:
（1）甲方以非法手段欺骗、强迫乙方进行训练、比赛或从事违法、违纪活动；
Party A , by unlawful means , deceive or compel Party B joining in trainging, match or deal with such acts as violation of law and rule.（2）甲方拖欠乙方工资奖金超过3个月；
Party A default Party B’s wage and bonus for exceeding three months.（3）乙方确实有不得已的原因需要辞职，应在30天前书面通知甲方并得到甲方确认。
Party B’s resignation , If and when for the cause against his will, should be affirmed by Party A to which on 30 days prior written notice.4、乙方有下列情形之一的，甲方不得解除本合同：
Party A can not terminated this contract under the occurrence of any of the following events by Party B.（1）患病或负伤，在规定的医疗期内；
Within the period of prescriptive medical treatment for illne or injury.（2）因公伤病，在本合同期内；
Within the life of this contract being illne or injury.（3）法律、法规、俱乐部规章、中国足球协会或中超委员会文件规定的其他情形。
Other circumstance and event stipulated by law, rule, club’s regulation and document of CFA and Super league committee.第十一条工作合同终止 CLAUSE XI TERMINATION OF CONTRACT1、本合同的终止，包括：Cause of termination include condition below:
（1）本合同到期自然终止；By expiration of this contract
（2）本合同在合同期内根据前条规定解除。
Termination of contract is being subject to preceding sentence within the life of contract.2、本合同到期终止、本合同在合同期内经双方协商解除，本合同在合同期内因甲方违约解除。乙方只要不属于本条下款规定的范围，可转会至任何国家的任何一家俱乐部，甲方无权干涉。
If and when termination on expiration of contract, resciion by consultation of Parties hereto throughout the life of the Contract and cancellation for Party A ‘s breach of liability within contratual duration , Party B can transfer to any club in any country only if which isn’t belong to the matter setted by following in this clause.To which, Party A is not entitle to intervene.3、乙方在下列情况下不能任意转会：
Party B couldn’t transfer other club at will under following circumtance.（1）乙方属甲方从其他国内或国外俱乐部租借的运动员，在本合同终止后（包括到期终止及在合同期内解除）应回归原俱乐部。如经原俱乐部同意可转租借到国内其他俱乐部，但这一转租每赛季只能有一次。
Party B, being rental-player from other club in home or broad, should return former club upon expiration of coontract include termination by contract expiration and resciion during life of contract.In case with cnosent of former club, Party B can transfer to other domestic club neverthele only once transfer each game season．
（2）不符合中国足球协会规定的国际转会年龄限制的国内运动员，未经中国足球协会书面批准，不能进行国际转会。
Don’t carry on international transfer club without conforming to the age limitation of international transfer stipulated by CFA or CFA’s written sanction.4、本合同到期终止，如双方同意续约（乙方为租借的运动员，需经借出俱乐部同意），应协商签订新的工作合同。
Parties hereto shall, if and when expiration of contract and with mutual agreement, conclude and inter into new employe contract by consultation, neverthele party B being rental player, need the consent of former club.5、在合同期内因乙方严重违纪或违法解除，乙方在处罚期内不得转会。Party B shall not transfer within punish period for his serious breaking discipline or cancellation for irregularity of law.6、在本合同终止（包括到期终止及在合同期内解除）后30个月内，乙方转会到其他俱乐部，该俱乐部必须与甲方签订转会协议，甲方有权依照中国足球协会的规定收取转会费。
In case Party B transfer to other club, within thirty(30)months from expiration of contract include termination of contractual maturity and resciion during contractual life, such club should conclude agreement of transfering, under which Party A is entittle to receive transfer fee in accordance to rule of CFA.第十二条违反工作合同的责任 Liability of breach of this contract
甲、乙任何一方因违反本合同，给对方造成经济损失，应根据损失情况和责任程度承担相应赔偿。
Each party should, where breah of this contract and make economical lo to other party, indemnify other party against lo in accordance to extent of lo and liability.第十三条合同争议 SETTLEMENT OF DISPUTES1、甲、乙双方在履行本合同过程中发生争议时，由双方协商解决。Any dispute ariseing out or related to execution of this contract shall be settled by consultation of parties hereto.2、双方不能协商解决时，可向中国足球协会诉讼委员会提起诉讼，乙方为中国籍运动员时，诉讼委员会的裁决为最终裁决。
Where fail to settle dispute by consultation each party could loadge a complaint to Dispute Judge Council of CAF.The finding of CAF is final decision to player with nationality of China.第十四条其他 MISCELLANEOUS1、本合同为中超委员会统一印制，一式三份，分别为A份、B份、C份，一次性复式填写，经双方签字盖章后生效，甲方执A份，乙方执B份，C份在运动员注册时向中超委员会备案。三份复式合同文本及中文或英文文本均具有同等法律效力。
This contract, being united to print by Super Committee, is three duplicates which formation of A, B and C copies on which tegather filled in once, take effct and force upon signature and seal of parties hereto.Copy A for Party A, copy B for Party B and copy C for putting on record of Super Committee while player enrolling.Three copies of this multiple contract and text in Chinese or English have equal law effect and force.2、本合同未尽事宜，按照《劳动法》、《合同法》及中国足球协会、中超委员会的相关规定执行，或依法依章程写入“补充协议”。“补充协议”必须在运动员注册时，与本合同一并向中超委员会备案，否则不予承认。
Matters not mentioned herein，if any，may be executed in accordance with LAW OF LABOUR , LAW OF CONTRACT and the related regulation of CFA or Super League Committee, or written into Supplement agreement subject to related rule and constitution.Supplement agreement should, while enrollment of player, take to Super Committee for records,otherwise not be accepted.3、“补充协议”不得在本合同外增加任何报酬条款，凡增加该类条款的补充协议，在中国足球协会管理的行业范围内不予保护和承认。“补充协议”内容如与本合同内容相抵触，以本合同为准。
Non of any recompense clause could be added in Supplement agreement beyond this contract, if any , without protection and acceptance within industry scope of CFA or Super League Committee.Where content of Supplement agreement have discrepancy or divergence to this contract, this contract shall prevail.4、本合同条款如与国际足联或中国足球协会规定相悖时，以国家的法律、法规和政策为准。
Where any discrepance, anbiguity, inconsistency herein is found with rule of FIFA , CFA, state’s law, code and policy shall prevail.5、外国籍运动员如有经纪人代理，须有经纪人在本合同上签字，如无经纪人代理须予以说明。
Broker of player with foreign nationality, if any, should set his hand to this contract.Where without the same explanation on which should be provided.甲方： Party A
