12.违纪处理 Procedures for Rule Violations
12.1 员工违纪,根据情节轻重按程序分别给与其不同的处理,并记入员工档案。Depending on the severity of the rule violation, there are different procedures for dealing with employees' rule violations, and of recording them in the employees' personal files.12.2 违纪处理分为:口头警告、书面警告、解除劳动合同。
The different procedures for rule violations are: verbal warning, written warning and termination of labour contract.12.3 口头警告:Verbal warning:
当员工初次犯有下列较小的过错时,将会受到口头警告处分,并给以0--50 元的经济处罚,口头警告由员工所在部门负责人行使,书面确认的材料由人力资源部保存(具体表格见附 件),所在部门保留复印件。如果员工在受到口头警告后的三个月内(考察其)没有犯任 何过错,这个口头警告将被自动撤销。
If an employee commits one of the following minor rule violations for the first time, he or she will receive a verbal warning and a fine of 0 to 50 RMB.The department in which the employee
works carries out this punishment and fills in the “disciplinary warning report form”, which is submitted to the HR Dept and a copy kept by the relevant department.If the employee does not violate any other rules within three months after the verbal warning(inspection period), then the warning is cancelled automatically.较小的过错是指:The following are minor violations of the rules:
a)迟到、早退、短时脱岗、串岗(少于一小时);
Being late for work, going home early, leaving the workplace during working hours, private chats with colleagues in other departments during working hours(all for le than one hour);
b)开始办公后超过1 小时报到工作、下班超过1 小时提前离岗或脱岗(1-4 小时)被计为4 小时缺勤(经济处罚加上扣半天工资);
Being late for work, going home early or leaving the workplace for more than one hour(but le then four hours)is regarded as miing from work for four hours(in addition to the fine, half a day's wages/salary will be deducted).c)违反公司卫生条例,未能保持公司清洁的卫生环境,乱扔垃圾,随地吐痰; Violation of the company's hygiene standards, not keeping the company environment hygienic & clean, littering or spitting;
d)当班时,没有穿适当的工作服或没有佩戴上岗牌;
Not wearing the proper work clothes or the ID badge during working hours;
e)工作时间做与工作无关的事;
Doing things unrelated to work during working hours;
f)在工作中不能与他人合作,对公司的运作产生负作用;
Not cooperating with other employees, causing a negative effect for the company's operation and production;
g)滥用公司财产,如利用计算机玩电脑游戏、与工作无关的网上浏览,不爱惜工作服、工作 鞋等劳保用品等;
Abusing company property, such as playing computer games or surfing on the Internet for
work-unrelated purposes on company computers, damaging the work uniform, shoes or other safety equipment;
h)拒不服从警卫人员对带进或带出物品进行检查;
Refusing that the security personnel check objects brought into or taken out of the company;
i)吵闹或无故大发脾气,污辱他人人格;
Making a big noise or having a big fit of temper for no reason, personally insulting other people;
j)未经许可,下班时间仍在工作场所逗留;staying in the company after working hours without
prior approval;
k)在公司禁止吸烟的地点吸烟,或在工作时间内吸烟。注:除了专门指定的吸烟区域外,所 有的地方都为无烟区域。
Smoking in the company's non-smoking areas, or smoking at all during working time.Note:
except for areas that are designated smoking areas, all areas are generally non-smoking areas.12.4 书面警告:Written warning:
当员工犯有下列较严重的过错或在口头警告的考察期(三个月)内再次犯较小过错时,将 会受到书面警告处分,同时罚款50--200 元,书面警告由员工所在部门写出(具体表格见 附件),部门负责人签署意见,人力资源部签署意见,书面确认的报告原件记入个人档案,员工本人及所在部门保留复印件。
如果员工受到书面警告后的六个月内没有犯任何错过,这个书面警告将被自动撤销。For employees who commit a second minor rule violation within the inspection time after his first
minor rule violation(three months), or who commit one of the following serious rule violations,the punishment is a written warning and a fine of 50 to 200 RMB.The employee's department
fills in the “disciplinary warning record form”, which is approved by the signature of the
responsible person in the department.The report is then submitted to the Human Resources
Department for approval.The original signed report is filed in the employee's file in the HR Dept.,a copy is given to the employee and another copy is kept by the employee's department.If the employee does not violate any other rules within six months after the written warning, then
the warning is cancelled automatically.较严重的过错是指:The following are serious violations of the rules:
a)不遵守安全规定,违反操作规程,造成责任工伤或责任事故;
Not respecting the safety regulations, violating the operating rules, causing an injury or an accident
by negligence;
b)私自动用、挪用消防器材、设施;
Using or moving fire equipment or facilities without permiion;
c)不服从工作安排或无合理理由而拒绝工作调动;
Not following the work schedule or refusing work instructions without a valid reason;
d)工作散漫,消极怠工,未能完成应做到的工作(生产)计划及任务;
Working in a slow, paive and slack manner, not having been able to complete the aigned work
(production)plan or duty;
e)在公司内赌博;Gambling in the company;
f)上班睡觉;Sleeping during working hours;
g)违反公司报酬保密规定的;Violating the agreement that compensation(salary/wages)is
confidential;
h)未及时向部门负责人报告已染上传染病;
Failing to immediately report to the person in charge of the department that one has an infectious
disease;
i)不按规定穿戴劳动保护用品;Not wearing safety clothing items as required by the rules;
j)未经公司批准,员工更衣箱内存放了员工制服和劳动保护用品以外的公司财物;
Storing any items that belong to the company, apart from the uniform and the safety items, in the
personal locker without the company's permiion;
k)私带外单位人员或小孩进入公司的生产、办公场所;
Bringing any outside persons into the production or office buildings of the company, including
children;
l)旷工(4 小时以上,3 天及以内);Miing without permiion(between four hours and three days);m)在公众、政府机构和客人面前损害公司形象;
Damaging the company's image in a public setting or in front of governmental organizations or
customers;
n)以客户的立场工作;Working in the interest of the customer instead of XXXX(when conflicting);o)在公司区域内擅自买卖、募捐、收取捐献、派发各类物品或印刷品等;
Engaging in trading, collecting donations, distributing any sort of objects or printed material etc.on
the company premises;
p)超越授权,武断专行;Overstepping one's authority and behaving in an arbitrary manner;
q)未经许可使用别人的电脑,查看别人的资料或文件;using the computer or reading files or documents of other employees without their prior permiion;
r)代替刷考勤卡;Using the IC card to clock in or out for a colleague at the time recording machine;s)在XXXX 安装、携带或使用未登记的或盗版的软件。
Installing or keeping unlicensed or fake software at the workplace or using it on a company
computer.12.5 解除劳动合同 Termination of labour contract
解除劳动合同由主管部门和人力资源部提出,经总经理同意,由总经理签字并作出决定。The termination of the labour contract is suggested by the relevant department and the HR
Department, and approved by the General Manager.12.5.1 解除劳动合同(提前三十天通知)Termination of labour contract with 30 days notice:
12.5.1.1 员工在书面警告的考察期内,连续犯二个有12.3 所列的“较小的过错”者,将被解除 劳动合同(提前三十(30)天通知本人,并按国家有关规定给予经济补偿)。
If an employee is found to have committed two more “minor violations”(as in 12.3)during the
inspection period after a written warning, his or her labour contract will be terminated with 30
days prior notice and a compensation payment according to the Chinese Labour Law will be
made.12.5.2 立即解除劳动合同 Termination of labour contract effective immediately
当员工犯有12.5.3 所列的“严重过错或行为”(或其他严重过错),或在书面警告的考察 20
期(六个月)内第二次犯有12.4 所列的“较严重过错”将会被立即解除劳动合同。
If an employee commits one of the serious rule violation as listed under 12.5.3(or another
serious rule violation);or if he or she commits a rule violation as listed under 12.4 a second
time during the inspection period(6 months)after a written warning, his or her labour contract
will be terminated effective immediately.12.5.3 下述所列的是导致立即解除员工劳动合同的其中一些严重过错或行为(并不包括全部): The following are all serious violations of the rules that lead to the immediate termination of
the labour contract(among others):
a)没有XXXX 事先的书面许可透露XXXX 的任何保密信息;
Disclosing any confidential information about XXXX without having obtained prior written approval
from XXXX.b)没有得到XXXX 的书面许可拿走或企图拿走XXXX 的重要文件;
Taking or planning to take important documents of XXXX without having obtained prior written
approval from XXXX.c)盗窃XXXX 业务有关的任何雇主所提供的资料;Stealing any busine-related materials
provided by busine partners of XXXX.d)在公司打架;Fighting(physically)within the company,e)受雇于XXXX 业务有关的任何雇主;Carrying out any work for busine partners of XXXX other than the employee's official XXXX work;
f)利用他/她在XXXX 任职的便利贪污或从事XXXX 之外的非法牟利;
Using his or her position within XXXX to accept bribes or obtain illegal advantages from outside
XXXX;
g)提供其教育、职业的虚假信息或用其它不诚实的方式获得他/她的工作职位;
Providing false information about his or her education and profeion or using other dishonest
ways to get a job/position.h)有欺诈的行为。包括但不限于说谎请假、提交伪造的医疗诊断书、伪造报销单据; Fraudulent behaviour, including, but not limited to, lying when applying for a leave, providing false
medical certificates and false expense claims.i)工作时饮酒或于任何时候吸毒;Drinking alcohol during working hours or consuming drugs at any time;
j)篡改、伪造公司文件;Tampering with or falsifying company documents;
k)借工作之便,从事私人的金钱交易和商务活动;
Abusing opportunities at work for personal financial transactions or personal busine activities;
l)未经XXXX 允许,从XXXX 的商业联系人处接受金钱或向他们借钱;对于礼物,不拒绝或 退回(除非价值较小);
Accepting or borrowing money from XXXX busine contact persons without the prior permiion
of XXXX;not rejecting or returning gifts(apart from those of small value);
m)如果员工偷盗公司的物品。
If an employee steals company property.n)如果员工犯罪而受到惩罚或触犯中国刑法并被判有罪。
If an employee commits a crime, receives a penalty or offends the Chinese Criminal Law and is
found guilty.o)连续旷工3 天以上。Miing work without permiion for more than three days.p)挑动、唆使员工对供应商、用户或其它员工进行恶意伤害,或组织、煽动员工故意扰乱公司 21

Provoking or instigating suppliers, customers or other employees to resort to malicious and harmful
