社区矫正论文：我国社区矫正存在的问题和对策

【中文摘要】社区矫正制度在西方发达国家已经成为刑罚的主要执行方式,但在我国却是个新兴事物,处于起步阶段。社区矫正是与监禁矫正相对应的刑罚执行方式,是指将符合社区矫正条件的罪犯置于社区内,由专门的国家机关在社会团体和民间组织以及社会志愿者的协助下,在判决、裁定或决定确定的期限内,矫正其犯罪心理和行为恶习,并促进其顺利回归社会的非监禁刑罚执行活动。2003年7月,最高人民法院、最高人民检察院、公安部、司法部联合下发《关于开展社区矫正试点工作的通知》,在我国开始社区矫正试点工作。本文选择这一现实热点议题,旨在从理论层面和实践层面两个视角对国外和我国的社区矫正作一介绍与论述,运用比较分析、理论联系实际等方法,渐进地对社区矫正制度予以描述和分析,并重点通过对济南市试点的实务研究,总结目前开展社区矫正工作的经验与存在的问题,探索提出改革和完善我国社区矫正制度的构想与建议。本文除结语部分以外,共分为四个章节。第一章为社区矫正的属性和作用,从社区矫正的定义入手,首先论述了国内外关于社区矫正的定义内容,并对这些定义内容进行了归纳和分析,并阐述了社区矫正的特征以及重点分析了社区矫正的作用。第二章是我国社区矫正的引入和嬗变,笔者对社区矫正制度的产生、发展进行了分析概括,并对社区矫正制度引入我国的过程和发展进行了全面汇总。第三章是我国社区矫正存在的问题,通过调查分析,将现阶段我国社区矫正存在的问题归纳为六个方面：

矫正主体的权责不一致、社区矫正队伍素质不高、社区矫正制度适用范围较小、矫正工作常常流于形式化、矫正组织网络不健全、社区矫正的认同度较低。第四章是社区矫正的改进对策,就如何解决这些问题,完善我国社区矫正制度,提出了自己的意见和建议,主要包括四点：加强基层司法行政机关建设、扩大社区矫正适用范围、健全社区矫正管理制度、提高矫正管理措施的科学性。

Corrections in China began experimental work.This choice of

this real hot topic, aimed at the theoretical level and

practical level from the perspective of both foreign and China as an introduction to community corrections and discuion of the use of comparative analysis, theory with practice and other methods, progreively be described on,the community

correction systemand analysis, and focus on practical pilot study in Jinan City, summed up the ongoing work of community corrections experience and problems, explore to reform and improve the idea of community correction system and suggestions, In addition to some conclusion other than this article, divided into four sections.The first chapter is the properties and role of community corrections, starting from the definition of community corrections, first discues the definition of

domestic and foreign content on the Community Corrections, and the content of these definitions are summarized and analyzed, and described the characteristics of community corrections, and analyzed a community correction role.The second chapter is the introduction of Community Correction and Change, the author of the emergence of community correction system,analyzes the development of broad, community correction system and the introduction of the proce and development of a comprehensive summary.The third chapter is a problem of

Community Corrections, through the investigation and analysis, will present the problems of Community Corrections summarized into six aspects:correct inconsistent with the main powers and responsibilities, the quality of community corrections is not high, the community correction system for a smaller range, corrected work is often a mere formality, correct

organizational network is not perfect, low degree of

recognition of Community Correction.The fourth chapter is the improvement of community correction strategies on how to solve these problems, and improve our community corrections system, put forward their views and suggestions, including four points:the main building to strengthen law enforcement
