【摘 要】法学证据学是运用证据判断规则来认定客观事实存在的一门法学科学。医学诊断学则是找出疾病存

在的证据的医学科学。证据学审查证据的真实性、关联性、合法性，并对证据进行质证的规则。用在医学诊断学上则

是对遵循医学科学原则及医生职业道德、依照诊疗程序，全面客观地收集、审核证据并落实证据。如存在充分、必要的证据即

可确诊；对证据的收集不全将导致漏诊；而对证据的错误判断则引起误诊。医疗纠纷诉讼中的“举证责任倒

置”规则告诫医务工作者必须重视诊疗过程中的证据。

【abstract】evidence law is the science of law which empbys the rule of authenticating evidence in the fact confir—

mation．medical diagnosis is medical science which finds out the factual evidences of the existing disease．evidence laws

carefully observe the proofs’authenticity，relationship，legitimacy，and question their validity．by these principles，medical

diagnosis should abide by medical science criterion，adhere to the profeional morality，follow the diagnosis and treatment

procedure，to collect evidences objectively and all—round，to scrutinize the demonstration，and，to consult the evident facts

with related persons．a right final diagnosis can be made if the factual evidences were suficient．a miing diagnosis shall

be resulted from failing to colect facts suficiently．a mistake diagnosis may be made due to wrong judgment for the testi—

如何有效提高诊断符合率是提高医疗质量的一

项重要内容。结合医疗及法律的一些特点，笔者尝

试将法学证据的一些基本原理应用于医学诊断中，旨在拓宽并建立正确的临床诊断思维，提高医疗诊

断的符合率，提高医疗质量。

一、医学诊断的思维模式探讨

诊断作为医务人员通过疾病的表现来识别疾病的一道程序已被广大医务人员所熟悉，医务人员通

过诊断来分析患者所患疾病的确切疾病名称、性质、患者肌体的机能状态，为制定治疗方案、判断预后和
