2009年，浙江省知识产权工作在省委、省政府领导下，各地各有关部门积极贯彻落实 “创业富民、创新强省”的总体部署，深入实施知识产权战略，推进长效机制建设，不断提升知识产权创造、运用、保护和管理能力，全省知识产权工作呈现良好的发展态势。

一、深入实施知识产权战略，不断优化知识产权政策环境

实施知识产权战略，是加快产业结构优化升级和经济发展方式转变的需要，是促进创新资源、优势传统资源转化为市场竞争力的需要。2009年12月，省政府办公厅颁布《浙江省贯彻国家知识产权战略纲要实施意见》。《实施意见》提出，通过加快构建知识产权创造、运用、保护体系和科学有效的工作机制，不断完善知识产权制度，积极营造良好的知识产权法治环境、市场环境、文化环境，争取到2020年，在全省形成知识产权创造与运用的聚集优势、知识产权流转的市场优势、知识产权有效保护的环境优势、企业知识产权制度建设的创新优势和知识产权文化优势，为建设创新型省份、开展国家技术创新工程试点和提升自主创新能力提供有力支撑。同年，宁波市人民政府颁布实施《宁波市知识产权战略纲要》。嘉兴市人民政府印发《关于贯彻实施大力推进知识产权保护工程的若干意见》。

2术开发区被认定为国家知识产权试点园区；龙泉、东阳被认定为国家传统知识知识产权保护试点市；杭州市西湖区等6个县（市、区）被批准进入国家知识产权强县工程。新认定杭州市下城区等9个县（市、区）为“浙江省知识产权工作示范创建县（市、区）”。

2009年，面对国际金融危机对省内实体经济运行影响日益加深的严峻形势，省级相关知识产权管理部门积极研究政策措施，帮助企业应对危机，知识产权制度对经济社会发展的支撑作用更加显现。省知识产权局积极参与“科技帮扶促调”专项行动，围绕区域支柱产业和特色经济的发展目标，主动帮助企业整合和运用专利信息。邀请国家专利局新能源汽车、船舶制造、化工、医药等领域资深审查员与我省150多家企业开展对接活动。积极引导企业大力引进省内外市场前景好、技术含量高的发明专利技术。省工商局开展品牌服务进民企活动，全年走访企业19563家，发放各类宣传资料21万份以上，组织培训人员13618人次；开展驰名、著名商标企业海外维权调查，指导新光、康奈、双鹿、梦娜等品牌企业实行海外维权。省商务厅在国内外出口展览会中，加强对参展企业的知识产权教育和宣传，做好展会期间知识产权保护相关工作，积极指导企业应对美国“337”调查。省经信委抓好行业重点企业的正版化示范工作，推荐了一批在行业内影响度较高的软件企业为全省软件正版化工作推进企业。省公安厅拓展警企协作机制，制定涵盖打击犯罪、预警防范、便民服务等内容的警企协作实施意见，建立品牌企业知识产权保护的举报投诉、咨询服务、预警防范等绿色通道。杭州海关开展“政策措施跟进”、“通关环境优化”等“五大工程”，为企业提供包括知识产权边境保护在内的多项服务。宁波海关建立关区保护自主知识产权联系配合制度，加强对自主知识产权企业进行维权手段和方法的指导，组织关区知识产权保护联络员走进企业，对企业维权进行现场答疑和指导。金融机构会同有关部门积极开展知识产权质押融资，全年发放专利质押贷款5720万元、商标质押贷款7.45亿元。

三、加强宣传培训，不断推进知识产权文化与人才队伍建设

加强知识产权宣传培训，推进知识产权文化建设，提高全社会知识产权意识，是实施知识产权战略的重要举措之一。2009年，省级相关部门积极组织形式多样、内容丰富的宣传培训活动。省知识产权领导小组办公室认真组织4〃26“知识产权宣传周”活动，开展“浙江省知识产权工作十大进展”评议活动，会同上海市、江苏省在上海联合举办了首届“长三角地区知识产权发展与保护状况新闻发布会”。省知识产权局等部门组织编制以专利、商标、版权、海关保护等内容的知识产权宣传展板，在浙江日报等新闻媒体介绍新修订的专利法。省版权局联合杭州市版权局举行 “4.26”世界知识产权日版权宣传活动启动仪式；配合《浙江省著作权管理办法》普及宣传，联合省版权协

6知识教育，已将该教育编入浙江地方课程的相关教材。中国计量学院开展知识产权第二学士学位教育。全省各地累计认定专利工程师370人。新增6位国家“百千万知识产权人才工程”高层次培养人选。省质检局进一步加强专业标准化技术委员会和人才队伍建设，新增7个全国专业标准化分技术委员会，组建环境保护、电光源等13个省级专业标准化技术委员会，新增国内标准化专家62人、国际标准化注册专家11人。

四、突出内外结合，持续扩大知识产权对外交流合作 长三角地区知识产权合作全面展开。2009年，浙江省知识产权局与上海市知识产权局、江苏省知识产权局共同签署了《长三角地区知识产权发展与保护合作框架协议书》，联手推进长三角地区知识产权（专利）工作的保护和发展。两省一市版权局共同签署了《关于建立长三角区域版权保护和版权服务协作机制的合作协议》。杭州海关、宁波海关与上海海关、南京海关建立了长三角地区海关知识产权保护工作联席会议制度，联席会议在杭州关区召开，共同研究了长三角地区海关统一执法尺度、协调执法行动、开展执法互助、实现信息共享等合作内容。

知识产权国际合作交流不断深入。2009年初，省知识产权领导小组办公室部分成员单位就我省知识产权保护情况与美国驻沪总领馆进行了会谈。4月，国家知识产权局和美国专利商标局主办、浙江省知识产权局和美国驻上海总领事馆承办的中美专利申请与保护研讨会在杭州举办。省知识产权局分别与日本贸易振兴机构上海代表处、英国ROUSE知识产权代理机构等在知识产权领域进行了合作。省版权局会同省政府新闻办组织了浙江省版权贸易代表团，对美国进行为期7天的工作访问，与美国出版业同行开展了一系列版权合作及图书出版发行交流活动。5月，“2009美国浙江版权贸易图书展”在纽约举行。

五、知识产权保护成效明显

（一）专利保护

2009年，我省专利申请量达108482件，比去年同期增长20.58%，成为全国第3个突破10万件的省份。其中发明专利申请量15646件,比去年同期增长29.69%。全省专利授权量79945件,比去年同期增长50.96%,其中发明专利授权量4818件,比去年同期增长47.38%。全年通过PCT申请国外专利237件，比去年同期增长33.9%。新审批代理机构2家，全省累计专利代理机构43家，专利代理办事机构10家，执业代理人264人，代理专利申请7万多件，约占全省申请总量的70%。国家知识产权局专利局杭州代办处全年共受理专利申请75357件，同比增长8.4%，受理质量位居全国前列。我省“激光气体分析系统的标定方法”等3项专利技术获第十一届中国专利金奖。“一种含环孢素的药物组合物”等5项专利技术获中国专利优秀奖。

省知识产权局认真开展“雷雨”、“天网”专利执法专项行动，在专业市场、商店和展会等流通场所检查商品、展品近万件，接受投诉100多件，查实和处理30多件。全年共受理专

102009年，全省各地文化管理部门认真做好以建国60周年大庆为中心的各项保障工作，切实加强文化市场监管。据统计,全省共受理举报7439件，出动检查人员9.5万人次，检查经营单位18.6家次，收缴非法物品157.8万件，其中非法音像制品104万张（盒）。2009年“扫黄打非”春季战役盗版非法出版物集中销毁活动，全省共销毁非法音像制品总量达97.5万余张。全省共有网吧服务器6000多台，服务器监控软件安装率达到了100％，网吧终端共有60余万个，网吧终端的监控软件安装率达到了98.2％，建立了较为先进的网吧技术监管系统。

（六）植物新品种权保护

2009年，全省农业植物新品种申请量20件，授权量25件。全省累计有涉及水稻、甘蓝型油菜、番茄、西瓜、柑橘属、甘薯、玉米、小麦、大麦属、百合属、棉属、猕猴桃属、辣椒、大豆、大白菜等农业新品种申请量141件，授权量60件。全省林业植物新品种申请量4件，授权量1件。省农业厅组织开展了“绿剑”1号集中执法行动，以水稻、玉米、大豆、蔬菜等种子为重点，查处生产经营假劣种子、超范围经营、无证生产经营等违法行为，共检查种子企业1710家，质量抽检种子430批次，查获违法种子8470公斤，切实保护了植物新品种权所有者合法权益。

（七）对外贸易知识产权保护

2009年，全省进出口1877.3亿美元，同比下降11.1%。其中出口1330.1亿美元，同比下降13.8%，出口占全国的份额达11.1%。进口547.1亿美元，同比下降3.7%。全省新批外商投资企业1738家，投资总额253.28亿美元，合同外资金额160.18亿美元，实际使用外资99.40亿美元，同比分别减少6.5%、11.5%、10.1%和1.3%。全省经审批和核准的境外企业和机构共计475家。其境外投资总额13.4亿美元，中方投资12.4亿美元，同比分别增长45.7%和43.5%。2009年涉及我省的“337调查”2起。

（八）海关知识产权保护

2009年，杭州海关共对进出口货物采取知识产权保护措施3722批次，同比增长157％。涉及侵权货物1742余万件，同比增长42％，价值人民币4018万元，同比下降16.36％。涉及耐克、阿迪达斯、彪马、飞利浦、古奇、克里斯蒂昂·迪奥、宝马、奔驰等多个国际知名品牌，以及英雄、虎头、三环等国内驰名商标，保护了27个国家和地区的249个权利人的合法权益。查处的多起案件分别入选了中国海关保护知识产权十佳案例、中国外商投资企业协会优质品牌保护委员会（QBPC）年度最佳案例和日本贸易振兴机构的年度最佳案例。义乌海关办事处升格为义乌海关，设立了知识产权科，这是全国首个在隶属海关层面设立的知识产权专门机构。针对国际出境邮件中侵权高发态势，认真部署开展了邮递、快件渠道知识产权保护专项行动，共查获涉嫌侵权邮包3285批次，货物29.5万件，价值人民币

314国第一个，也是目前唯一开展试点审理部分专利纠纷案件的基层法院。宁波、温州、金华中院成为全国首批实行跨区域就近指定管辖专利纠纷案件的法院。新增湖州和嘉兴中院为审理专利纠纷案件的第一审法院。目前，全省具有专利权纠纷案件管辖权的法院9个，具有部分知识产权民事案件管辖权基层法院18个，数量均居全国第一。11个中级法院中，杭州、宁波、温州、金华、台州、绍兴和嘉兴等7个中级法院已成立了知识产权审判庭，18个具有部分知识产权民事案件管辖权的基层法院中，已有13个成立了知识产权审判庭。

In 2009, under the leadership of CPC Zhejiang Provincial Committee and Zhejiang Provincial Government, municipalities and departments implemented firmly the strategy of intellectual property in accordance with overall arrangement of “making people get rich by encouraging entrepreneurship and making the province prosper by innovation”.The province promoted in full swing the construction of long term mechanism and kept on improving the capability of creation, application, protection and administration of IPR.IP work in the province presented healthy and fast development.I.Implementing firmly IP Strategy and Optimizing Continuously the Environment of IPR Policies

Implementing IPR strategies is a neceity of speeding up optimization and upgrade of industrial structure and transferring the way of economic development, as well as a neceity of promoting the transfer of innovative resource and advantageous traditional resource to market competitivene.In December 2009, General Office of Zhejiang Provincial Government iued the Suggestions on Implementation of the Outline of the National IP Strategies in Zhejiang Province.In the Suggestions, it was brought forward that an integrating advantage of creation and application of IPR, a market advantage of IPR transfer, an environmental advantage of effective protection of IPR, an innovation advantage of IPR system in the enterprises and a cultural advantage of IPR should be formed so as to support the construction of an innovative province, the experimental project of the national technical innovation, and the upgrade of the ability of independent innovation by 2020.To realize the targets, the province must make use of means to accelerate the establishment of the system for creation, application and protection of IPR and effective working mechanism, to improve IPR system and to build up sound law market and cultural environments for IPR, In the same year, Ningbo Municipal People’s

718strengthen the cultivation and promotion of ability of standardization innovation and promoted the enterprises to transfer the technical innovative results to the standards.In 2009, the enterprises in the whole province of Zhejiang participated in preparing and editing of 12 international standards and 415 national standards, including 4 international standards and 132 national standards as the first drafting entities.One hundred and one enterprises were granted as standard innovation ones.With the standardization experimental projects as carrier, it guided industrial groups and industrial parks to set up and implement alliance standards and promoted small and medium sized enterprises to apply international standards and advanced standards of other countries.Hangzhou, Ningbo, Wenzhou and Jinhua have become the national IP work demonstration cities.Taizhou was recognized as a national demonstration city of IP construction.Shaoxing was recognized as a national IP demonstration city at trial basis.Ningbo National High-Tech Industrial Development Zone and Hangzhou Xiasha Economic & Technical Development Zone were recognized as national IP parks at trial basis.Longquan and Dongyang Counties were recognized as national IP protection city for traditional knowledge at trial basis.Six counties(cities/districts)including Xihu District of Hangzhou City were approved to join the projects of the national IP strong county.Nine counties(cities/districts)including Xiacheng District of Hangzhou City were newly recognized as “Zhejiang Provincial IP Demonstration Construction County(City/District)of”.In 2009, facing the severe impact of international financial crisis to economic operation in Zhejiang province, the provincial IPR administrative departments concerned studied actively the polices and measures to help the enterprises in the province to find opportunities in the crisis, to seek for solutions to difficulties, and to develop themselves in adversity.Functions of IP system in support to development of economy and society become more obvious.Zhejiang Provincial Intellectual Properties Office took part in the special actions of “Aistance, Support, Motivation and Adjustment by Science & Technology”.Centered on development targets of the regional backbone industries and economy in specialty, the office helped actively the enterprises to conform and utilize patent information.It invited the senior inspectors from State Intellectual Property Office of China in the areas of new-energy automobiles, ship manufacture, chemical industry and pharmaceutics to have dialogues with more than 150 enterprises in Zhejiang province.It launched a project to encourage enterprises to introduce the invention patents with good market potential and high technical contents both from other provinces and abroad.Zhejiang Provincial Industrial & Commercial Bureau carried out the action of branding service to private enterprises.In this year, it visited 19,563 enterprises, distributed more than 210,000 publicity materials of various types and organized the training for 13,618 person/times.It carried out investigation on the overseas right-safeguarding of the enterprises, which own famous and well-known trademarks and provided guidance for the brand enterprises, such as Neoglory, Kangnai, Sonluk and Mengna, to overseas right-safeguarding.In the domestic and overseas exhibitions of exports, Zhejiang Provincial Commercial Department strengthened IP education and publicity to enterprises, which take part in exhibitions, paid great attention to IPR protection during the exhibitions, and provided guidance actively to enterprises, which faced “337” Investigation from USA.Zhejiang Provincial Economy & Information Industry Commiion spent great energy to promoting installation of legal software in key enterprises and recommended a batch of influential software enterprises as promotion models of software legalization.Department of Public Security of Zhejiang Province developed the cooperation system between the police and the enterprise, gave suggestions on the implementation of the cooperation between the police and the enterprise, which were covering crime crackdown, early-warning and prevention, and consultation services to the enterprises.In addition, it set up the green channels for the brand enterprises to report, claim, and consult the iues regarding IPR protection.Hangzhou Customs carried out “the five projects” including “the policy and measure follow-up” and “the optimized clearance environment” and provided the enterprises with several services including the IPR boundary protection.Ningbo Customs set up the liaison and coordination system regarding the protection of independent IPR in its customs jurisdiction.It strengthened guidance to the independent IPR enterprises regarding the ways and methods for right-safeguarding.It organized the

122Property Office enhanced training on intellectual property actively.In 2009, IP Office system in Zhejiang Province held 525 training courses with investment to training amounted to RMB 7.29 million.There were 49,940 person taking part in the trainings, among which, 10 trainings were held by provincial intellectual properties office and 88 were held by municipal intellectual properties offices.Together with Zhejiang Provincial Foreign Experts Bureau, for the first time, provincial intellectual properties office chose 20 young and middle-aged specialists from the area of IP to receive an IP training of 3 months in University of Houston in USA.Cooperated with China Measurement Institute,.The office constructed a training base of IPR staff.Zhejiang Copyrights Bureau held “the training course of copyrights protection and copyrights trade to the publishing companies in Zhejiang province” and “the training course of copyrights protection to newspaper offices in Zhejiang province”.With a theme of “IPR and Technical Innovation”, Department of Public Security of Zhejiang Province carried out a remote training to the policemen in Zhejiang Province by means of video.Department of Justice of Zhejiang Province strengthened the force on publicizing IPR laws and regulations and guided actively the lawyers to provide legal services and law safeguarding to IPR work.It organized the lawyers to hold circuit lectures named as “Using Legal Way to Prevent and Solve Enterprises’ Crisis” and some commonweal lectures and training of different themes and types such as “How can an Enterprise Avoid Legal Risks under the Financial Crisis” and “Set up harmonious Labor Relation in an Enterprise”.Zhejiang Provincial High Court held the training courses of IPR judgment in Zhejiang province and the training courses for newly recruited IPR judges.The judges of 35 years old and le and with an education level of university and above were chosen from the intermediate courts and concerned gra-root courts to accept training in IPR tribunal of Zhejiang Provincial High Court for half a year in rotation.A database of talent IPR judges was set up, in which judges with certain experience and career expectation were stored.Together with Zhejiang Provincial IPR Administrative Departments concerning law-enforcement, it carried out the selection of people's jurors.Strengthening the universal education of intellectual property, cultivating IPR talent people are strategic measures and basic guarantee to construct an innovative province.Zhejiang Provincial Education Department carried out the IPR education in primary schools and high schools by the way of adding IP knowledge in curriculum and textbooks.China Measures Institute carried the education of the second bachelor’s degree of IPR.Six people were selected as the candidates for a hundred of high-level profeionals in national “Project for Thousands of IPR Talents”.Three hundreds and seventy patent engineers were qualified accumulatively from different cities in Zhejiang province.Zhejiang Provincial Quality Inspection Bureau strengthened further the construction of the profeional standardization committee and the team of talents.Seven national profeional standardization branch committees were added.Thirteen profeional standardization committee of the provincial level including the environmental protection and the electricity and light resources were constructed.Sixty-two domestic experts of standardization and 11 registered experts of international standardization were added.IV.Expanding continuously external communication and cooperation on IPR in combination of domestic and foreign requirements

The cooperation of IP in Yangtze Delta was carried out comprehensively.In 2009, Zhejiang Provincial Intellectual Property Office, Shanghai Municipal Intellectual Property Office and Jiangsu Provincial Intellectual Property Office signed together the Framework Agreement of Cooperation on IPR Development and Protection in Yangtze Delta to promote protection and development of IPR(patents)in Yangtze Delta.Copyrights bureaus of the two provinces and the municipality signed together the Cooperative Agreement on Setting up Coordination Mechanism on Copyrights Protection and Copyrights Service in Yangtze Delta Area.Hangzhou Customs and Ningbo Customs set up the joint conference system for the customs IPR protection in Yangtze Delta Area with Shanghai Customs and Nanjing Customs.The joint conference held in Hangzhou Customs jurisdiction studied together the cooperation on united criterion of law enforcement，526newly 99 well-known company names and the total reached 770.There were 12 newly added brand bases and the total was 67.Amongst 2009 Top 100 Powerful Counties for Trademark Development in China, Zhejiang province accounted for 30, including 22 counties(cities)of top 50.Zhejiang province investigated and handled 7,233 cases of trademark infringement cases.The amount of penalty and confiscation was RMB 119.17 million.Thirty-two criminal suspects in 34 cases were transferred to the justice organizations.The protection of Olympic logos was effective and will be done continuously in the future.3.Protection of Copyrights Zhejiang province kept the position of number 4 in the country with 4,759 pieces of software copyright registered, which increased 15.2% compared with the same period of the previous year.There were 6,815 pieces of other art works registered, which created a new record in the history and ranked at the top in the country.One hundred and forty-seven contracts of foreign books were registered and approved for publishing.Six hundred and four authorization contracts were registered, which concerned with foreign video products, electronic publications, books and computer software.Together with Zhejiang Provincial Public Security Department and Zhejiang Provincial Communication Administration Bureau, Zhejiang Provincial Copyrights Office launched a special action to crackdown internet infringement of copyright.During the period of the special action, copyrights offices at different levels received and heard 47 cases involving 50 servers.Authorities in Zhejiang province investigated 90 cases of copyrights infringement, among which 47 cases were administratively punished.The amount of the penalty was RMB 232,500.One case was transferred to the judicial organization.Twenty-eight illegal websites were closed.4.Protection of Geographical Indication Products There was a new breakthrough in the work of protecting geographical indication products.Four geographical indication products for protection named as Longquan Reishi, Yunhe Jew’s Ear, Huiming Tea and Liye White Lotus were added.Accumulatively, 31 geographical indication products are under protection in Zhejiang province.Longjing Tea obtained the first-batch double-confirmed geographical indication of China and Europe, by which, the influence and the competition of Longjing Tea was upgraded in European market.The geographical indication products were publicized and promoted.Suichang Bamboo Charkle and Longjing Tea were recommended and selected for Shanghai World Expo.Longjing Tea, Hangzhou White Chrysanthemum and Shaoxing Wine were organized for China High-Tech Agricultural Fair.Amongst the newly-added geographical indication proven trademarks, “Zhoushan Large Yellow-Fin Tuna”, “Zhoushan Hairtail” and “Zhoushan Blue Crab” were listed into the first batch of sea products geographical indication proven trademarks in the country.Zhoushan city set up the administration committee for geographical indication proven trademarks of Zhoushan sea products.Centered on the license of trademark, Jinhua city carried out the events such as quality evaluation of Jinhua ham and the specially contracted shops.Zhejiang Provincial Industrial & Commercial Bureau put an emphasis on Longjing Tea and made out the Provisional Method for Management and Protection to Certificated Trademark of Longjing Tea to promote the application of Longjing Tea Certificated Trade in the enterprises.The geographical indication proven trademarks played good functions in different cities.The economic benefits of the products such as Jingshan Tea, Xianju Waxberry and Longquan Celadon were improved obviously.Anji White Tea, Chumen Shaddock and Huangyan Orange were exhibited and promoted in Asia Pacific Geographical Indication International Workshop and were concerned and welcome.5.Protection of Audio-Video Products IPR In 2009, the cultural administration departments of different cities in Zhejiang province did good job in supporting to 60th Anniversary of China and strengthened the supervision of the cultural markets.According to the statistics, in Zhejiang province, 7,439 cases of reports and complaints were registered.And 95,000 inspectors/times were dispatched，930Ningbo Customs terminated 442 batches of cases of infringements, which was 48.32% higher than that of the previous year.The value of goods reached RMB 65.33 million with an increase of 33.47% compared with that of the previous year.About 7,236 pieces of infringement goods were detained with an increase of 45.18% compared with that of the previous year.The goods involved in the cases were the clothes, shoes and caps of Nike and Adidas, and the daily chemical products of Dove and Colgate.The supervision on key commodities, key airlines and destinations that have more infringement to independent IPR was strengthened.In the whole year, 185 cases of infringement to independent IPR were found out.The value of the cases was more than RMB 23 million.More than 4,214 infringement goods involving Three-Ring, Tiger Head, Hero and Royal were detained.9.Cracking down IPR Crimes by the Public Security Organs In 2009, the public security organs in Zhejiang province implemented seriously the outline of national IP strategy.According to the requirements of “playing the dominant function of justice protection”, it executed conscientiously the function of criminal justice.In this year, 187 criminal cases of IPR violation were registered for investigation, 170 cases were solved and 285 criminal suspects were investigated and punished.The value of the cases was RMB 102 million and the lo of RMB 40.73 million was taken back.The Cooperative Mechanism between different types of policemen was improved further for taking up each other’s advantages and forming joint force to improve the efficiency of criminal crackdown.Under united command of Zhejiang Provincial Public Security Department, a batch of severe and large cases of infringing international famous trademarks such as “Jiuyang” Bean Milk Machine and HP were tracked down succefully.10.Cracking down IPR Crimes by the Procuratorate Organs In 2009, the Procuratorate organs strengthened further IPR protection, focusing on cracking down IPR crimes.Applications of IPR violation for arrest were 160 suspects in 88 crime cases, among which, 142 suspects violation, 3 suspects in one case of duplication infringement and 5 suspects in 3 cases of commercial secret violation.On the basis of investigation, Zhejiang Provincial Procuratorate iued a document of Situation of Crimes of IPR Violation in Zhejiang Province and the Procuratorate’s Countermeasures so as to guide cases handling to the front line.By perfecting the system of involving in serous cases in advance and reporting and filing cases, a special group for IPR crimes was set up in order to improve itself, to strengthen the internal coordination and to upgrade the ability of law enforcement.The platform of 96150 administrative law enforcement for united reporting and complaining, which was proposed by Yiwu Municipal Procuratorate and was constructed with Yiwu Municipal Procuratorate’s active involvement, was in smooth operation.“Yiwu Pattern” obtained actual effects.11.Judicial Protection of IPR In 2009, 2,838 IPR civil cases of first instance were filed and 2,598 cases were closed, which increased 73.68% and 53.36% respectively compared with those in 2008.309 IPR civil cases of second instance were filed and 310 cases were closed, which increased 0.98% and 2.31% compared with those in 2008.The cracking down crimes of IPR infringement was strengthened.In the whole year, 115 criminal cases of IPR violation were handled and closed in first instance, which increased 25% compared with that in 2008.Two hundred and nine suspects were sentenced guilty, which increased 30.63% compared with 2008.According to laws, supervision and support to IP administrative organs were executed.Courts received and closed 2 administrative cases of IP law enforcement in first instance.The appeal case of patents disputes between Chnt and Schneider were succefully heard and
