诉讼时效的法律法规
1、民事诉讼时效效力：
---权利人不丧失起诉权，(程序胜诉权)，权利人起诉的，法院应当受理
---法院在审理中不得主动援用诉讼时效期间经过的理由驳回原告诉讼请求
---法院查明诉讼时效确已经过的，应判决(而非裁定)驳回原告的诉讼请求(非驳回起诉)
---虽已超过时效，但当事人自愿履行的，权利人仍可以接受---因为实体权利本身并未消灭，当事人履行后又反悔的，不予支持
2、民事诉讼时效适用范围：
---适用于债权请求权，包括合同，侵权之债，不当得利与无因管理

之债，缔约过失之债等
---不适用物权，人身权，知识产权等绝对权，但其受侵害而产生的债权请求权，也受诉讼时效约束
---国家财产未授权给公民，法人经营，管理的，受到侵害时不受诉讼时效限制
---具有强制性，不允许当事人约定排除或变更其适用
3、民事诉讼时效的种类：
普通：两年
特殊：1年，3年，4年，20年(不得中止，中断，但可延长)
商品不合格时：违约请求权为1年，侵权请求权为2年
4、民事诉讼时效的起算：自知道或应当知道权利被侵害时
---明确约定履行期限的债权，自期满之日的次日起算

---未约定履行期限的债权，自权利人主张权利时起算，若给予宽限期，则从宽限期届满的次日起算
---人身伤害中，当时发现受伤的，从侵害当日起算，未发现的，从确诊日起算
---职务侵权赔偿请求，从职务行为被依法确认为违法之日起算
----分期付款买卖合同的诉讼时效，按相应的履行日期分别计算，而不从最后的履行日期开始计算
5、民事诉讼时效的中止：不可抗力或其他障碍
发生时间：诉讼时效期间的最后六个月内
6、民事诉讼时效的中断：
---起诉：刑事附带民事诉讼/申请仲裁/调解/申请强制执行/申请支付令/申请破产/向行政机关申诉
不视为起诉：自动撤诉/不予受理/驳回起诉/原告不到庭

---请求：口头或书面均可，对象包括
债务人本人/债务保证人/债务人之代理人/财产代管人
---承认：口头或书面均可，形式包括
同意偿还/请求延期/提供新担保/支付利息或租金
可以反复中断(不超过20年)
除斥期间又称不变期间
一般适用于形成权，期间届满消除权利本身，不可变
行使撤消权的期间/领取提存物的期间
一般自行为成立之日起计算
