7月5日，司法部出台了一份关于废止《司法部、建设部关于房产登记管理中加强公证的联合通知》的通知，这意味着伴随房屋遗产继承事项多年的“公证”环节已不再成为必需。
因继承、受遗赠取得不动产申请登记的，由申请人选择是否需要公证。
需要公证的手续如下
所需材料：办理房产继承公证，公证机关应要求当事人填写公证申请表，并提交下列证明、材料：
一、法定继承应提交：
1、申请人的居民身份证或户口簿及其复印件;
2、代理人代为申请的，委托代理人需提交授权委托书和身份证及其复印件;其他代理人需提交有代理权资格的证明;
3、被继承房产的产权证明;
4、被继承人的死亡证明;

6、被继承人的婚姻、父母、子女情况证明及有关亲属关系证明;

2、被继承人的遗嘱书;
3、有遗嘱执行人的，提交执行人的身份证件及其复印件;

申请人不提交经公证的材料或生效的法律文书的，按下列程序办理：
1、(不公证)申请人需提交的申请材料(原件)。所有继承人或受遗赠人的身份证、户口簿或其他身份证明;
2、被继承人或遗赠人的死亡证明，包括医疗机构出具的死亡证明;公安机关出具的死亡证明或者注明了死亡日期的注销户口证明;人民法院宣告死亡的判决书;其他能够证明被继承人或遗赠人死亡的材料等;
3、所有继承人或受遗赠人与被继承人或遗赠人之间的亲属关系证明，包括户口簿、婚姻证明、收养证明、出生医学证明，公安机关以及村委会、居委会、被继承人或继承人单位出具的证明材料，其他能够证明相关亲属关系的材料等;
4、放弃继承的，应当在不动产登记机构办公场所，在不动产登记机构人员的见证下，签署放弃继承权的声明;
5、继承人已死亡的，代位继承人或转继承人可参照上述材料提供;

7、被继承人或遗赠人生前有遗嘱或者遗赠扶养协议的，提交其全部遗嘱或者遗赠扶养协议;

受理登记前应由全部法定继承人或受遗赠人共同到不动产所在地的不动产登记机构进行继承材料查验。申请人签署继承(受遗赠)不动产登记具结书。不动产登记机构可以就继承人或受遗赠人是否齐全、是否愿意接受或放弃继承、就不动产继承协议或遗嘱内容及真实性是否有异议、所提交的资料是否真实等内容进行询问，并做好记录，由全部相关人员签字确认。
