国务院关于修改《国内航空运输旅客身体损害赔偿暂行规定》的决定(附英文)
国务院1993年12月13日
国务院决定将《国内航空运输旅客身体损害赔偿暂行规定》第六条修改为：“承运人按照本规定应当承担赔偿责任的，对每名旅客的最高赔偿金额为人民币七万元。”
附件：国内航空运输旅客身体损害赔偿暂行规定
第一条为确定国内航空运输承运人对旅客身体损害应当承担的民事责任，制定本规定。
第二条本规定适用于国内航空旅客运输中发生的旅客身体损害赔偿。
前款所称国内航空旅客运输，是指根据航空旅客运输合同，运输的始发地、约定经停地和目的地都在中华人民共和国领域内的航空旅客运输。
第三条旅客在航空器内或上下航空器过程中死亡或受伤，承运人应当承担赔偿责任。
第四条承运人如能证明旅客死亡或受伤是不可抗力或旅客本人健康状况造成的，不承担赔偿责任。
第五条承运人如能证明旅客死亡或受伤是由旅客本人的过失或故意行为造成的，可以减轻或免除其赔偿责任。
第六条承运人按照本规定应当承担赔偿责任的，对每名旅客的最高赔偿金额为人民币七万元。
第七条旅客可以自行决定向保险公司投保航空运输人身意外伤害险。此项保险金额的给付，不得免除或减少承运人应当承担的赔偿金额。
第八条向外国人、华侨、港澳同胞和台湾同胞给付的赔偿金，可以兑换成该外国或地区的货币，其汇率按赔偿金给付之日中华人民共和国国家外汇管理部门公布的外汇牌价确定。
第九条旅客或其继承人与承运人对损害赔偿发生争议，可以向人民法院起诉。
第十条本规定由中国民用航空局负责解释。
第十一条本规定自****年五月一日起施行，一九五一年四月二十四日政务院财政经济委员会发布的《飞机旅客意外伤害强制保险条例》同时废止。

INTERIM PROVISIONS CONCERNING COMPENSATION FORBODILYINJURYOF PASSENGERS IN DOMESTIC AIR TRANSPORT
(Adopted at the 31st Executive Meeting oftheStateCouncilonJanuary 3, 1989, promulgated by Decree No.28 of the State Council ofthe People's Republic of China on February 20, 1989 and become effective as of May 1, 1989)
Article 1
These Provisions are formulated for thepurposeofdefiningthecivil liability that domestic air carriers shall bear for the bodilyinjuryof paengers.Article 2
These Provisions shall apply to the compensation for the bodily injuryof paengers that occur in domestic air paenger transportation.The term “domesticairpaengertransportation”referredtointhe preceding paragraph denotes any airpaengertransportationinwhich, according to the contract of carriage, the place of departure, theagreed stops, and the destination are all within the territoryofthePeople's Republic of China.Article 3
The carriers shallbeliableforcompensationfordeathandinjury sustained bypaengersonboardanaircraftorinthecourseof embarkation or disembarkation.Article 4
The carriers shall not be liable for compensation provided they canprove that death or injury of paengers is caused by force majeureorbythe paengers' own health conditions.Article 5
The carriers' liability to pay compensation maybereducedorexempted provided they can prove that the death or injury of paengersiscaused by the negligence or wilful misconducts
onthepartofthepaengers themselves.Article 6
The maximum amount of compensation shall be 70,000 Renminbi yuan foreach individual paenger, for which the carriers are liableforcompensation as under these Provisions.Article 7
Paengers may at their own discretion to cover with an insurancecompany an insurance against accidental bodily injury in airtransportation.The payment of the insurance indemnity, however, shall notexemptorreduce the amount of compensation that the carriers shall be liable for paying.Article 8
Compensation paid to foreigners, overseas Chinese, compatriotsfromHong Kong and Macao, and compatriots from Taiwanmaybeconvertedintothe currency of the country or region concerned and the rate of exchange shall
be decided as per the listed rate of exchange officially published bythe
State Administrative department for control offoreignexchangeofthe People's Republic of China on the day on which the compensation is paid.Article 9
In the event that a dispute with respect to thecompensationforinjury arises between the paengers or their heir and the carrier, they may file a suit with the people's court.Article 10
The Civil Aviation Administration of China shall beresponsiblefortheinterpretation of these Provisions.Article 11
These Provisions shallbecomeeffectiveasofMay1,1989andthe Regulations Concerning Compulsory Insurance Against Accidental InjuryforAir Paengers promulgated by the Financial & Economic Commiionofthe Administration Council of the People's Republic of China on April 24, 1951 shall be nullified simultaneously.
