基层行政机关论文：基层行政机关执法方式变革初探

【中文摘要】随着社会主义民主进程的加快,我国行政体制改革越来越受到各阶层的关注,学界对其研究的领域也越来越广泛、越来越深入、越来越具体,作为其重要内容,执法方式变革这一课题也逐步进入人们的视野。虽然我国在行政法制建设方面取得了巨大成就,但是相对于经济、民事和刑事等方面仍存在着较大的差距。在经济社会发展的背景下,随着社会多元化思潮和公民的权利意识增强,基层行政机关执法方式滞后所带来的问题逐渐增多,并引发了一系列社会矛盾和纠纷,受到了社会各界的广泛关注和深思。解决好基层执法问题、提高执法效率和质量、保障公司权利、维护社会稳定成为执法方式变革的关键。本人通过对相关的专业学术专著、期刊、学术论文的学习和对基层行政执法现实案例的研究,结合自身从事的公安消防工作,对基层执法所存在的问题进行了多方位的分析,深挖了长期以来在我国基层执法中存在的重实体轻程序、滥用自由裁量权、职权不清、作风粗暴等错误执法方式的根源,明确了基层执法机关执法理念错位、执法体制落后、人员素质亟需提高等深层次原因,为下一步整改提供了依据。现在我们国家正在提倡建设社会主义和谐社会,我国政府也在努力塑造服务型政府,这为基层行政机关的执法方式变革指明了方向。本文通过分析理论基础和政治基础,提出了以和谐执法方式作为基层行政机关执法方式变革的重点,并就基层行政机关和谐执法方式的建构进行了详细的论述。和谐执法方式的建构包括树立和谐执法的意识、完善和谐执法机制、提高和谐执法的能力、创新和谐执法方式等几个方面,对现有执法方式提出了上至指导思想、下至具体办法的全方位改革思路。尤其在改革创新方面,本文参考了国内外行政执法先进的理论及实践成果,依据我国基层行政执法中存在的问题,有针对性地就行政执法和解制度、与行政执法相对人建立联络机制、进一步规范自由裁量权、提高公众参与程度、强化责任追究机制等新型执法方式的应用进行了阐述,初步为基层行政机关执法方式变革的提供了理论参考和实践依据。作为适应建设社会主义和谐社会发展方向的一种执法理念,和谐执法方式在基层行政机关的应用具有重要的意义,它不仅有利于保障公民权利、防止权力滥用,还可有效地协调基层行政执法中合法性与合理性、法律效果与社会效果、执法效率与执法公正的关系,进一步维护社会稳定。任何一种理论只有在实践在才能得到检验,希望本文能为我国的行政体制改革尽到微薄之力。

【英文摘要】With the acceleration of the socialist

democratization proce, the reformation of China’s

administration system start getting more and more attention from different levels of society.The research of the academic field is also going wider, deeper and more detail.As the most important part of this proce, the subject of changing the way of law enforcement is coming out step by step.Our country had already made brilliant achievements at the administrative legal system construction.But compared with the legal system

construction on the economy, civil and criminal parts, the administrative part is still le developed.Under the

circumstance of high-speed developed economic society, with the society diversification trend and the enhancement of the citizens’consciousne, the dated law enforcement style of basic level administrative organ leaded a series of social contradictions and disputes.Problems are increasing gradually, which caused widely attention and concern.The key point to revolute the way of law enforcement is to enhance the efficiency and quality of law enforcement, protect and guarantee the right of company and maintain the stability of our society.I made a multi-dimensional analysis on the existed problems in the field of basic level administrative organ law enforcement proce, which through my deeply research on different kinds of profeional academic monographic, journals, academic paper and the actual cases on law enforcement of basic level administrative organ, and also, combined with my working

experience in the public secure fire department.In order to provide the basis to the next correction step, I found out the reasons for such problems.The primary causes are

the?substantive?law?is?superior?to the procedure law, abuse of discretion, unclear authority, and rough enforcement style.The deep-seated reasons are displacement of idea, backward in enforcement system, and the low personnel quality.For now, our country is encouraging people to establish a harmonious

socialist society, and the government of China is also trying to be shaped as a service-oriented kind of government, which clearly pointed out the direction of changing the way of

administrative organ law enforcement.This article pointed out that we should put the harmoniously way of law enforcement as the most important part in the proce of changing way of administrative organ law enforcement, which based on the

analysis of both theoretical basis and political basis.And also gave a detailed discuion about construct a harmoniously way of administrative authorities and enforcement.To

constructed a harmoniously way of law enforcement included, set up the consciousne of harmoniously law enforcement, complete the mechanism of harmoniously law enforcement, make

improvement of harmoniously law enforcement ability, make innovations of new ways of harmoniously law enforcement, and so.Pointed out not only guiding ideology, but also specific measures of the changing proce.In this article, especially in the aspect of reform and innovation, referred advanced theories and practical results of administrative law

enforcement on both domestic and foreign side, combined with the actual problems in basic level administrative law

enforcement, specific expounded the reconciliation system of the administrative law enforcement, establishment of

administrative enforcement counterpart contact mechanism, standardize discretion, make improvement of public

participation rate, strengthen the mechanism of responsibility, and so on, which provided a theoretical and practical basis for the innovation of administrative law enforcement.The

harmoniously way of law enforcement, as a new law enforcement idea of harmoniously socialist construction proce, should has fundamental significance in basic level administrative organ application.It is cannot only protect the right of citizen efficiently, and avoid abuse of power, but also can effectively coordinate the legitimacy and rationality of
