鉴于**市公路桥梁基建总公司以下（简称“承包人”）与**省高速公路建设开发有限公司（以下简称“业主”）签订修建**道路发展项目щ**至**高速公路土建工程施工招标第C合同段合同协议书，并保证按合同规定承担该合同段工程的实施和完成及其缺陷修复，我行愿意出具保函为承包人担保，担保金额为人民币（大写）________________。

本保函的义务是：我行在接到业主提出的因承包人在履行合同过程中未能履约或违背合同规定的责任和义务而要求索赔的书面通知和付款凭证后的7天内，在上述担保金额的限额内向业主支付任何数额的款项，无须业主出具证明或陈述理由。在向我方提出要求前，我行将不坚持要求业主应首先向承包人索要上述款项。我们还同意，任何对合同条款所作的修改或补充都不能免除我行按本保函所应承担的义务。

本保函在担保金额支付完毕，或业主向承包人颁发交工证书之日起失效。
