法学教育（www.xfhttp.com－雪风网络xfhttp教育网）的改革首先是教学方法的改革，把学生从被动听课的角色转变为主动学习的角色。“教”与“学”是一门艺术，是两大主体0教师和学生3围绕知识的传授和吸收，能力的培养和适用而展开的双边教学活动。在这一活动过程中，教师必须注重教法，即授“人以渔而非授人以鱼”。笔者认为：辩论式法学教学方法是培养法学大学生各种能力的重要手段。本文拟就此作一初步探讨，以期引起同行们的关注，共同研究、实践。
一、辩论式法学教学方法概述
辩论式法学教学方法是教师、学生就某一单元教学内容以问题为纽带而展开分析、讨论、辩驳及总结，从而获得真知的教学方法。教师要适当引导学生对所提问题展开辩论；学生要开动脑筋对教师所提问题进行分析、辩论并提出新的问题，实现师生之间、学生相互之间知识的互动。其特点是：
（一）以问题为纽带。首先要求教师善于用问题引导学生，就其教学内容精炼出一些有争议的或假设性的问题。其次也要求学生敢于根据自己所读书籍或社会现实提出与教学内容有关的'实质性或假设性的问题，用问题来穿针引线，因为问题是知识获取之源，发现问题是智慧动力之源，解决问题是能力形成之源。
（二）体现学生的主动性。打破传统教学方法中教师满堂灌，学生被动接受的模式。首先表现在课前的阅读和查找资料上，学生根据教师所列书目，主动阅读，动手摘录，动脑思考甚至主动查找新的信息资料。其次表现在课堂教学中，参与分析、辩论并根据自己的所读、所思主动提出问题。
辩论式法学教学方法是一个将课前准备、课堂教学和课后总结有机结合起来的教学过程，具体包含了“导读――提问――分析、辩论――总结”这样一个基本的教学思维过程。
第一阶段是导读，在每个单元教学内容开课前，教师引导学生有目的地阅读一些书籍，查找相关的信息、资料等。首先，教师应根据教学内容收集整理一些资料发给学生。选编出教学资料 （包括一些案例）都应当是具有代表性的，它们应包含多层次的不同学派的观点、思想，或者是曾经确立过或影响过某一重要法学理论和原则的案例；其次，列出多层次的书单，让学生大量阅读书籍（包括相关的法律、行政法规等），吸收各种信息。在广垠的知识海洋里，教师也无法穷尽某一学科的全部，同时永无尽头的科学知识的发展，使“现代知识不断老化”。因此，教师鼓励学生潜心阅读，在知识的宫殿里独自寻找所需，最终通过课堂上的互相辩论、研讨，实现师生之间、学生之间知识的交流、融合；最后，教师可以提供相关的电子资源目录，包括法律计算机数据库，法律光盘和法律网络资源站点等，鼓励学生利用先进的法律文献检索方法主动去查阅更多的相关资料、信息。随着信息时代进程的加快，法律文献检 “索” “国际法检索”、“历史法
