摘要：由于“重实体、轻程序”的传统思想的影响和惩罚犯罪与保障人权的矛盾，我国补充侦查制度在理论与实践上存在着诸如公安机关与检察机关的补充侦查权限模糊、不必要或超期羁押使补充侦查超期严重等问题。针对这些问题，应通过进一步完善补充侦查制度，建立检察引导侦查制度，健全侦检沟通和配合机制，赋予检察机关对侦查机关违法违纪人员的处罚建议权等措施在立法和司法实践两方面予以改进和完善。

Problems of Supplementary Investigation System in China and the Corresponding Strategies

Abstract: Together with the influence of the traditional viewpoint of “emphasizing the noumenon and neglecting the procedure”, the contradiction between penalty of the criminal and the safeguard of human rights has resulted in quite a lot of theoretical and practical problems in the scope of supplementary investigation system in China.Illegibility of the supplementary investigation right between the office of public security and the procuratorial organs, long extension of supplementary investigation caused by unneceary or over-due detainment are instances of this kind mentioned above.These problems are expected to be solved both in the sphere of legislation and that of judicial practice through the strategy of further improvement of the supplementary investigation system, the strategy of establishing the system of Investigation under the Procuratorial Organ’s Guide, the strategy of strengthening the communication and cooperation mechanism between the office of public security and the procuratorial organs, and the strategy of authorizing the procuratorial organs rights of punishment or advising over the law-breakers from the office of public security.Keywords: supplementary investigation, Investigation under the Procuratorial Organ’s Guide,Crime control, protection of human rights
